Acceptable Use Policy

1. Introduction
By using the Service, you agree to comply with this AUP. Violation of this AUP constitutes a material breach of the Terms of Service and may result in immediate suspension or termination of your Account.
This AUP applies to all users of the Service, including Providers (developers and businesses who integrate with SolvaPay) and End-Users (individuals who purchase products or services from Providers through SolvaPay).
2. General Conduct
You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not use the Service in any way that violates any applicable federal, state, local, or international law or regulation.
3. Prohibited Activities
The following activities are prohibited on the SolvaPay platform. You may not use the Service to facilitate, promote, or engage in any of the following:
3.1 Illegal Goods or Services
Offering, selling, or distributing any goods or services that are illegal in the jurisdiction of the Provider, the End-User, or SolvaPay. This includes any products or services that require a government license or permit that the Provider does not hold.
3.2 Fraud, Deception, and Misrepresentation
Any fraudulent, deceptive, or misleading activity, including but not limited to: creating fake or misleading product listings; impersonating any person or entity; phishing or social engineering; providing false or misleading business information; manipulating reviews, ratings, or other feedback systems; or engaging in any scheme to defraud End-Users or other users of the platform.
3.3 Adult and Sexually Explicit Content
Offering, selling, or distributing pornographic or sexually explicit content or services.
3.4 Gambling and Betting
Offering, facilitating, or promoting gambling, betting, lotteries, sweepstakes, or games of chance, whether or not they require a stake or entry fee, unless the Provider holds all required licenses and has received prior written approval from SolvaPay.
3.5 Controlled Substances and Pharmaceuticals
Selling or distributing illegal drugs, controlled substances, prescription pharmaceuticals (without proper licensing), drug paraphernalia, or any substance that is illegal to sell without a license in the applicable jurisdiction.
3.6 Weapons, Explosives, and Firearms
Selling or distributing weapons, firearms, ammunition, explosives, or related accessories, or any items designed to cause physical harm.
3.7 Unlicensed Financial Services
Providing financial services without proper licensing, including but not limited to: unlicensed money transmission or payment services; unregistered securities offerings; pyramid schemes, Ponzi schemes, or multi-level marketing programs; unlicensed lending, loan brokering, or debt collection; or binary options trading.
3.8 Cryptocurrency and Digital Assets
Conducting token sales, initial coin offerings (ICOs), operating unregulated cryptocurrency exchanges, or facilitating other unregulated digital asset transactions, unless the Provider has received prior written approval from SolvaPay and holds all required regulatory approvals.
3.9 Sanctions Violations
Engaging in any transaction or activity involving parties or jurisdictions subject to economic sanctions imposed by the United States (OFAC), the European Union, the United Nations, or any other applicable sanctioning authority. This includes transactions with individuals or entities on sanctions lists, or transactions involving embargoed countries or regions.
3.10 Intellectual Property Infringement
Offering, selling, distributing, or facilitating the distribution of products or services that infringe, misappropriate, or violate any third party’s intellectual property rights, including but not limited to: counterfeit goods; pirated software, media, or content; unauthorized copies of copyrighted material; or services designed to circumvent digital rights management or other technological protection measures.
3.11 Harassment, Hate Speech, and Violence
Offering products or services that promote, incite, or facilitate: violence or physical harm against any person or group; terrorism or violent extremism; hate speech, discrimination, or harassment based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, or any other protected characteristic.
3.12 Spam and Abuse
Using the Service to send or facilitate the sending of bulk unsolicited communications (spam); manipulating or abusing the platform’s features, APIs, or systems; conducting denial-of-service attacks or any other form of interference with the Service or its users; or using automated means to access the Service in violation of the Terms.
3.13 Data Harvesting and Unauthorized Surveillance
Using the Service to collect, scrape, or harvest personal data without the knowledge and consent of the individuals concerned; operating spyware, keyloggers, or other unauthorized surveillance tools; or engaging in any unauthorized monitoring of communications or data.
3.14 Pre-Orders, Paid Waitlists, and Crowdfunding
Offering pre-orders, paid waitlists, crowdfunding campaigns, or any arrangement in which payment is collected before the product or service is available for immediate digital delivery, unless the Provider has received prior written approval from SolvaPay. These activities present an elevated risk of chargebacks and disputes because fulfillment is deferred, and SolvaPay may be unable to verify delivery. Providers who wish to offer pre-orders or similar arrangements should contact SolvaPay at contact@solvapay.com to discuss approval.
3.15 High-Risk Activities
Using the Service for activities that present an elevated risk of financial loss, regulatory action, or reputational harm, including but not limited to: sale of tobacco products; sale of products making unsubstantiated health claims; travel booking services without proper bonding or licensing; or any activity identified as restricted by our Payment Service Provider(s).
4. Payment Service Provider Compliance
Providers must also comply with the acceptable use policies, restricted business lists, and terms of service of the Payment Service Provider(s) used by SolvaPay. The current Payment Service Providers are listed on our Sub-Processors page. Restrictions imposed by the Payment Service Provider apply in addition to those set forth in this AUP.
5. Provider Responsibilities
Providers are responsible for ensuring that:
(a) their products, services, and business activities comply with this AUP;
(b) they do not knowingly allow their End-Users to engage in prohibited activities through products or services offered via the SolvaPay platform;
(c) they promptly report any suspected violations of this AUP to SolvaPay at contact@solvapay.com;
(d) they maintain appropriate safeguards and policies to prevent misuse of their products or services offered through the platform.
6. Monitoring and Enforcement
6.1 Monitoring
SolvaPay reserves the right, but is not obligated, to monitor use of the Service for compliance with this AUP. SolvaPay may review Provider listings, transaction patterns, End-User reports, and other information to identify potential violations.
6.2 Reporting Violations
If you become aware of any violation of this AUP, please report it to contact@solvapay.com. We take all reports seriously and will investigate reported violations promptly.
6.3 Enforcement Actions
If SolvaPay determines, in its sole discretion, that a user has violated this AUP, SolvaPay may take any or all of the following actions:
(a) issue a warning and request immediate corrective action;
(b) temporarily suspend the user’s access to the Service;
(c) permanently terminate the user’s Account;
(d) withhold or delay payouts in accordance with the Reserves and Fund Holds provisions of the Terms of Service;
(e) remove or disable access to any content or listing that violates this AUP;
(f) report the violation to law enforcement or other appropriate authorities;
(g) pursue any other remedy available under the Terms of Service or applicable law.
6.4 Immediate Suspension
SolvaPay may immediately suspend access to the Service without prior notice in cases of:
(a) active fraud or illegal activity;
(b) a requirement from a Payment Service Provider;
(c) a legal or regulatory obligation;
(d) an imminent risk to the platform, other users, or SolvaPay’s reputation.
6.5 Notice and Cure
For violations that do not require immediate suspension, SolvaPay will generally provide written notice to the user, specifying the nature of the violation and a reasonable cure period (typically fourteen (14) days) to remedy the violation. Failure to cure within the specified period may result in suspension or termination.
7. Appeals
If your Account has been suspended or terminated due to a suspected violation of this AUP, you may contact SolvaPay at contact@solvapay.com to dispute the action. SolvaPay will review appeals in good faith and will provide a response within a reasonable timeframe.
8. Changes to This Policy
SolvaPay reserves the right to modify this AUP at any time. We will post the updated AUP on this page and update the “Last Updated” date. For material changes, we will provide at least thirty (30) days’ advance notice through the Service or via email. Continued use of the Service after such notice constitutes acceptance of the updated AUP.
